"Dear Ms Ackland,
I am writing in response to your final demand letter dated 20th February 2019.
I refute this demand as I have not received any internet service from TalkTalk and my case has not received ‘reasonable skill or care’ in providing the service (breaching Paragraph 8.1 in Terms & Conditions), as received poor customer support in trying to resolve this issue.
I attempted to contact TalkTalk by phone on the following dates:
I also emailed TalkTalk on:
In addition to these methods, I also wrote a letter to the TalkTalk Salford Office in October.
As part of the TalkTalk Terms and Conditions, the services have not been delivered with reasonable skill or care, thus I am claiming a breach of contract (see Paragraph 22.1(b) and 22.1(c)) and request that TalkTalk cancel the bill for £190.87 and remove my name and details from its accounts.
As my service has never gone live, therefore my contract has never started, according to Paragraph 4 of the Terms and Conditions. Therefore, I am entitled to a refund me the £14.45 that was taken from my account. I would like this paid in cheque to Henry Watson and sent to the address above.
Finally, I am exercising my final right to reject this service, as the service has not been provided (Paragraph 22.1(a)(iv) of the Terms and Conditions) and want immediate renumeration and annulment of contract (see Paragraph 15.3(a) of the Terms and Conditions)."
I sent this letter on 28th February (signed delivery) to Zoe Ackland and Tristia Harrison, which was signed for on 4th March 2019.
On 8th March, I was contacted by a debt collection agency.
If my complaint is not resolved in coming week, I will be force to go to the small claims court.
